In re: Illegal detention of a Noida resident by Uttar Pradesh Police

On 16 October 2026, the Allahabad High Court ordered the immediate release of a Noida resident, finding he had been subjected to unlawful pre-arrest detention by the Uttar Pradesh Police. Criticizing the officers for ignorance of Bharatiya Nagarik Suraksha Sanhita procedures, the court observed the police were acting as a law unto themselves. Following these judicial observations, the Uttar Pradesh Police suspended the involved Station House Officer and the investigating Sub-Inspector on 23 October 2026.

The Allahabad High Court ruled that a complainant's dissatisfaction with a police investigation or the omission of certain provisions under the SC/ST Act, 1989, does not constitute sufficient grounds to prosecute police officers for willful neglect under Section 4 of the Act. The Court further held that an administrative inquiry and recommendation are mandatory prerequisites before initiating penal proceedings against public servants under this section.

State vs Four Policemen — Krishna Kumar Yadav custodial death case

In the 2021 custodial death case of 24-year-old Krishna Kumar Yadav in Jaunpur, eight policemen surrendered before the court on 1 January 2022. On 7 October 2026, the Allahabad High Court rejected the bail applications of four of the accused policemen based on CBI material and directed the trial court to expedite the proceedings.

Allahabad High Court — CBI probe into police encounter in Uttar Pradesh

The Allahabad High Court ordered a CBI investigation into a May 2025 police encounter in Shravasti on 28 August 2026 after ruling the police FIR account appeared prima facie false. Previously, on 21 August 2026, the court directed the trial court to provide the rape accused applicant with legal aid before passing a fresh order on his discharge application. The court also criticized the Uttar Pradesh Police for recurring patterns of alleged staged encounters and procedural guideline violations.

State vs. Accused (unnamed) — Sexual assault and rape case, Ghaziabad

Following an initial complaint on 7 July 2026, an FIR was registered in Ghaziabad on 28 July 2026 regarding allegations of rape and sexual assault against an employer. The Allahabad High Court ordered the Uttar Pradesh DGP on 19 August 2026 to conduct a supervisory inquiry into local police officials for their initial refusal to register the case. The court subsequently ruled on 26 August 2026 that police cannot refuse to register FIRs in sexual assault cases based solely on a lack of digital evidence.
